How to Assess Your Benefit Program

A Handy Litmus Test:

A common question many of our clients and prospects like to ask is how they can know if their healthcare and benefits program is truly providing value to their employees. It’s a great question. There are so many options when creating a benefits bundle, even the best HR managers may not be able to assemble the optimal mix without a little trial and error.

But there are four simple questions you can ask yourself when evaluating benefit components, to help gauge their effectiveness and value:

ERISA SPD – Compliance Webinar Replay

Were you able to attend the “How a Wrap Can Prevent Thousands in Penalties” webinar we co-sponsored with myHRcounsel™ at the end of September? We are resending the link to replay the webinar for those who were unable to attend, or could benefit from another review of the material.

ESC provides our clients with an SPD that meets ERISA requirements. However, that is rarely the case and far from guaranteed for any other health welfare benefit plans you offer your core or hourly employees. A Wrap document from myHRcounsel™ can take care of the ERISA requirements for those plans and save you tens of thousands in penalty and interest.

U.S. District Court Rules ACA Unconstitutional

No immediate changes expected for employers but a Supreme Court battle is anticipated.

U.S. District Judge Reed O’Connor for the Northern District of Texas ruled on Friday that the Affordable Care Act (ACA) is unconstitutional, in its entirety.

A final ruling, however, may be months or even years away. It is important to keep in mind that the Individual Mandate is still in effect for 2018 and does not end until January of 2019. Thus, individuals must still have individual health coverage in order to avoid being penalized.  The other provisions of the ACA, such as the Employer Mandate, continue unchanged until there is an ultimate determination on this controversial and polarizing law.

ERISA Compliance Webinar Replay

ERISA reporting and employee disclosure violations can add up quickly. ERISA compliance is not an option, it is the law, and failure to comply can generate thousands in penalties!

On Thursday, September 20, 2018 ESC hosted our trusted partner myHRcounsel for a webinar to discuss ERISA compliance, penalties, and the benefits of SPD “Wrap” documents.

Many employers rely on their broker or plan administrator to provide the necessary ERISA disclosures to plan enrollees. While ESC provides ERISA-compliant disclosures to employees enrolled in any of the products we offer, this is often not the case with other health and welfare benefit providers. If you offer benefits to internal or temporary employees other than those provided by ESC, you will not want to miss this free webinar.

ESC partner myHRcounsel is a law firm specializing in employment law including issues related to ERISA and ACA compliance. This free webinar will explain your staffing company’s responsibilities under ERISA, and provide a quick overview of the legal and compliance services myHRcounsel has developed for staffing companies (and deeply discounted for ESC clients!).

Click here to watch a replay of the ERISA Compliance Webinar or click here for more information about myHRcounsel’s services which have been significantly discounted for ESC clients.

Do you need a Wrap document?

According to the Employee Retirement Income Security Act (ERISA) passed in 1974, employers offering health and welfare benefits (health, dental and/or vision plans, AD&D/Term/Disability Insurance, wellness programs, etc) are required to provide plan participants with a Summary Plan Description (SPD) that clearly outlines details about the plan, its administration, and its benefits and claims process. (Click here to learn more about SPD documents).
